I - Privacy and the Protection of Personal Data
The privacy and protection of the personal data of all customers and users of the services provided by WorkPlanet, Lda, At any given moment, they are an essential aspect of the way it acts and organises itself.
WorkPlanet, Lda thus aims to ensure that all its Customers are aware, at all times, of the rules and principles relating to the protection and processing of personal data, making every possible effort to ensure the security of this data, in accordance with the rules and procedures defined in the applicable legislation, namely the Personal Data Protection Act (Law no. 67/98, 26 October).
WorkPlanet, Lda thus aims to ensure that all its Customers are aware, at all times, of the rules and principles relating to the protection and processing of personal data, making every possible effort to ensure the security of this data, in accordance with the rules and procedures defined in the applicable legislation, namely the Personal Data Protection Act (Law no. 67/98, 26 October).
In this way, the company adopts the best technical and organisational practices to protect customers' personal data against loss, involuntary or unlawful deletion and improper alteration, as well as against integrity breaches, unauthorised access or disclosure.
On the WorkPlanet, Lda website you may find links to other websites that are unrelated to our company. The provision of such links is made in good faith, and WorkPlanet, Lda cannot be held responsible for the collection and processing of personal data carried out on these websites, nor can it be held responsible for the accuracy, credibility and functionality of websites belonging to third parties. Therefore, the provision of links to other websites unrelated to WorkPlanet, Lda does not imply any assumption of responsibility in relation to them and, consequently, this Privacy Policy does not apply to them.
WorkPlanet, Lda also recommends that its Customers adopt complementary security measures, including keeping equipment and programmes properly updated and configured, using protection against malicious software and firewalls and not browsing websites for which it does not have the necessary guarantees of authenticity.
This Privacy Policy may be amended or revised at any time, and any amendments or revisions will be duly publicised and communicated on the WorkPlanet, Lda. website.
II - What is Personal Data?
Personal data is information of any nature and regardless of its medium, including sound and image, relating to an identified or identifiable natural person. An identifiable person is one who can be identified directly and indirectly, in particular by reference to an identification number or to one or more factors specific to his or her physical, physiological, mental, economic, cultural or social identity.
III - Responsible for the Collection and Processing of Personal Data
Workplanet, Lda is responsible for the collection and processing of personal data on the WorkPlanet, Lda website, under the terms of article 3(d) of Law no. 67/98, 26 October, and it is up to the latter to decide, in the context of the provision of Customer Services, which personal data is collected, the means of processing the data and the purposes for which it is used.
IV - Liability for data communicated to third parties
Workplanet may, in the course of its business, subcontract third parties for the purposes mentioned above and for the development and management of its IT systems, which may imply access by these entities to the personal data of its Customers. When this happens, Workplanet takes the appropriate measures to ensure that the entities that will have access to the data offer the highest technical, organisational and human guarantees at this level.
Third parties subcontracted by Workplanet will therefore be obliged, under the terms of the law and the agreement signed with Workplanet, to implement appropriate technical and organisational measures to protect personal data against accidental or unlawful destruction, dissemination, alteration, disclosure, unauthorised access and against any other form of unlawful processing, and will be bound by special duties of professional secrecy and confidentiality.
Outside of these cases, Workplanet will only pass on its Customers' personal data to third parties when:
a) it is obliged to do so by virtue of a legal provision and only to the strict extent of its obligations or,
b) where expressly permitted by law, if the Customer expressly and specifically authorises such transmission and is duly informed in writing of the recipients of the personal data and the purposes of the data transmitted.
In any case, Workplanet remains responsible for the personal data provided by its customers, which may involve the transfer of their personal data outside of Portugal. In such a case, the company declares that it will strictly comply with the determination of the suitability of the country of destination of the information with regard to the protection of personal data and the requirements applicable to such transfers, in accordance with the law.
V - Conditions for the Collection of Personal Data
Workplanet, Lda only collects and processes the personal data of WorkPlanet, Lda Customers with their express consent, in accordance with each of the specific purposes of the processing in question, under the terms of the Personal Data Protection Act.
Clients may withdraw their consent at any time, free of charge.
There is, however, personal data that is indispensable for the provision of services (mandatory data), and Clients are duly informed in advance of this need and of the consequences of not providing this data.
If the personal data, considered indispensable, is not provided by Customers or proves to be insufficient, incorrect or out of date, Workplanet, Lda will not be able to provide the Service(s) subscribed to, in which case Customers will assume full and exclusive responsibility for the insufficiency or incorrectness of the data transmitted.
VI - Personal Data Retention Period
Workplanet, Lda will only keep personal data for the period of time strictly necessary to allow:
a) the provision of the Service(s);
b) the fulfilment of onesoft's legal obligations;
c) the fulfilment of the purposes of collection and/or processing;
d) the exercise of customer rights and the fulfilment of corresponding obligations. In cases where the National Commission for the Protection of Personal Data (CNPD) authorises the retention of Customers' personal data for periods longer than the duration of the service contract, in view of the specific purpose of the processing in question, the Customer will be duly informed in good time of this purpose and of the retention period in question.
After the retention/saving period has elapsed, under the terms set out above, the Customers' personal data will be permanently deleted by workplanet, Lda.
VII - Customers' rights with regard to their personal data
In accordance with the provisions of the Personal Data Protection Act, the Customer is guaranteed the right to access, correct, update and delete their personal data free of charge.
In any of the above cases, the Customer may exercise their legitimate rights by sending a written communication to the following email address info@workplanetlda.com addressed to the Personal Data Protection Officer.
VIII - Unsolicited electronic communications for direct marketing purposes
The contact details of the Customer, who is a natural person, may be used by Workplanet, Lda in the course of its contractual obligations, if the Customer expressly authorises it, in direct marketing actions and promotion of services provided by WorkPlanet, Lda, under the terms of article 13 of Law no. 41/2004, 18 August in the version conferred by Law no. 46/2012, 29 August.
In the case of a WorkPlanet, Lda Customer who is a legal person, Workplanet, Lda may send unsolicited communications for direct marketing purposes relating to goods and services provided by Workplanet, Lda or by a company in the same Group, unless the Customer expressly refuses to receive this type of communication in the future and registers on the national list of legal persons who expressly object to receiving unsolicited communications for direct marketing purposes, which the Directorate-General for Consumer Affairs (DGC) is responsible for keeping up to date.
In any of the aforementioned cases, the Customer shall have the right to expressly object, free of charge, via email, to the sending by Workplanet, Lda of electronic communications for direct marketing purposes, the Customer may thus exercise its legitimate rights by sending written communication to the email contact info@workplanetlda.com,addressed to the Personal Data Protection Officer.
